Family Law in Australia
The Family Law System and Courts are governed by the Family Law Act 1975 (Cth) and are administered by the Federal Circuit and Family Court of Australia. Western Australia has its own division.
Australia is party to the Hague Convention and does not support children being removed overseas by a Parent in the event of a separation or divorce. New laws are being introduced in 2023 to ensure parties are however able to relocate overseas in the event of Family Violence.
